Thanks to every person who answered this post. I managed to get an appointment in mumbai for Aug 2nd. This will give enough time to send necessary document from my end and also give enough breathing to file the application.

Your case is a bit different, I am not sure if you could avoid paying back as GC process is for your benefit so a company could request a pay-back, even though amount is a bit high and you did not get anything in return. I would compare it to a situation where company gives an employee a laptop and expect person to return it when s/he leaves a company.
helloh1's clause is different - company receives benefits by training its employees so it's just plain wrong to request a pay back in that case.
So just forget about it and move on, we all make mistakes and here in the US those mistakes usually cost money.

What about if the I-140(EB2) rejected?. The 485 will be rejected too?. What are the possibilities of I-140 rejection?

The request to adjudicate I-485 will go out only after EB-2 I-140 is approved. I-140 rejection "should" not trigger your pending EB-3 I-485 rejection but it all depends on how the IO interprets your case. He could issue an RFE (I would guess) asking for an EVL for your EB-3 case. In my colleague's case however, TSC automatically adjudicated the I-485 since the new EB-2 I-140 carried the same Alien# as the pending I-485. It seems TSC has a system in place to identify such cases, NSC doesn't. Another colleague of mine whose I-485 is pending at NSC and EB-2 I-140 approved at TSC is still waiting for I-485 approval and its been a month since his I-140 was approved.

Requirements to change employer when GC is pending:
- I-140 should be approved
- More than 180 days should have passed after filing I-485. The clock for 180 days starts from 485 receipt.
- Approved EAD
Significance of 180 days barrier
If you have approved I-140 and EAD, you can change employer without having to wait for 180 days. But then your employer can revoke the I-140 which invalidates the 485 application. After 180 days from I-485 receipt, I-140 cannot be revoked so that is why it is always recommended to invoke AC-21 after 180 days from the 485 receipt.
After 180 days, you cannot change jobs, you can only change employers
When you invoke AC-21, you have o fulfill two conditions:
1.) You new jobs has the same or similar job description as mentioned in the green card labor certification application
2.) You salary should be almost the same as the wages mentioned in GC labor certification application
This means, you have to continue to stay in the same job title and job description till the time your GC is approved. If you fulfill the requirements mentioned above, you do not have to inform USCIS when invoking AC-21. You just switch employer. At some point USCIS will send you a query asking for the information of the employer who continues your green card application. It is best to take up job where the job title and job description is exactly the same as specified in your GC labor certification application. Any variance in the job title or job description could be extremely damaging to the GC application processing.
It is best to not to change to an employer offering you anything less than the wage rate specified in the GC labor certification. On the higher side, it is better not to take up a job that offers more than 4% more salary of that specified in the GC labor certification. It is hard to resist 20-30K higher salary, but one would have to resist the temptation for taking the job offering higher salary. Otherwise, there is a risk of USCIS denying the GC application.
USCIS doesn�t account for dollar appreciation or devaluation. USCIS also doesn�t account for annual inflation when calculating the wage rate. So even if your labor certification was applied in 2003, you still have to continue at the job with the salary specified in the GC labor certification. Meeting with Congresswoman Zoe Lofgren�s staff, San Jose

A group of us met with the with Chief of Staff and Congressional Aide at Zoe Lofgren�s office in San Jose, yesterday. The meeting went very well and lasted an hour. The Chief of Staff was very knowledgeable about the issues. She ofcourse knew that the IV team had already met with the Congresswoman and the staff at her DC office. One of her first comments was about that meeting and she remarked that it was very good to have � an organized group� like IV. She was very appreciative of what IV was doing as an �organized group� � doing their homework and research and putting out presentations and materials that brought out the core issues very clearly and hiring a very competent lobbying firm to help execute our agenda. She wanted to know who made those presentations (thanks to Berkeley Bee!!!!!) J.. In fact, she repeated her appreciation quite a few times about IV. She also mentioned that she had read about IV in the Roll Call and was looking forward to meet the group.
We went through the presentation, explaining the issues � most of which the Chief of Staff was already were aware of. The Congressional Aide was not aware of a few and we used the opportunity to explain the issues. Needless to say, personal examples helped to get the point across very well. While we went through the issues at the BECs and the USCIS, we quoted quite liberally from the Ombudsman report and the Presidents Economic report and from logiclife�s post on the backlog centers. At one point we were asked/ told that since these were infrastructure problems that are very deep, it is probably going to take time to completely address the fixes in the system. We again took that opportunity and told them about IV goals such as the 3yr H1B extensions instead of 1yr and the recapture of the visas lost between 2001 and 2004 - which would provide interim relief to the people affected by the backlog. We explained how the 3yr extensions instead of 1yr would relieve the USCIS of additional work and allow them to focus their efforts on actual processing / clearing of backlog. When they commented that the Dept of Homeland Security may want this to be a 1yr process, we pointed out that currently 3yr extensions are being offered to people who have filed for I485, so we are merely asking that the same be extended to people with their Labour and I-140 pending.
They offered us a couple of suggestions:
1. To talk to the Congress people �on the other side� especially in the Judiciary committee. They wanted us to consult with our lobbying firm first. They strongly felt that we should be talking to lawmakers who are not pro-immigration. They said that we may need to study their district and the industries there and try to point out how those industries are benefited by immigrants directly or indirectly.
2. To collaborate with the giants in the Private sector who employ highly skilled legal immigrants because some of them have very loud voices on the hill.
We do have an action to get back to them with a list of states that we know that don�t issue drivers license renewals for 1yr. Can someone please provide us with this information so that we can relay it back to them?
They also wanted a softcopy of our presentation and the supporting materials. We are working on that.
Overall, they had a very good opinion about ImmigrationVoice. To quote them again,
�Very Organized Group� � and they felt that organized groups make a great difference,
�Done their homework very well in terms of research, pinpointing the exact issues, presenting and communicating them in a way lawmakers / people understand�, �Have a very good lobbying firm�. They wanted IV to continue what we are doing and meet with lawmakers on either side (pro and anti immigration), so that when a �window of opportunity� presents itself, we can use it to our advantage. The Chief of Staff reiterated this point and mentioned how important it was to be prepared for this �window of opportunity�.

One of the recent NewYork times best seller - "The World is Flat" is actually inspired by the words of Infosys Ex CEO - Nandan.....There are numorous articles about Indian offshore companies & thier success in all the top magazines - NY Times, Washington Times, Fortune, Forbs, Business Week, Forbes....you name it, there were plenty of artcles in each and every of these.
Coming to the attrition of employees - Top Indian offshore comany's average attrition rates are around 12-15%, which is still on par with World-wide IT companies (including IT Bigwigs in US). Even great US companies like INTEL got so many frustrated employees (& ex emps) that they started a special website (www.faceintel.com) expressing all their bitterness.
At the end, you can still say - they are just glorified bodyshoppers...that's fine. Everyone has the right to live in thier own paradise :)

Brother, your idea is good but practically it is very difficult.
Do you see a donate progress bar at the top, it took an entire month and lot of pushing to get 10,000 US$ in donation.
People are not willing to donate, many have questions about credibility and what work is being done, some have lost entire hope and hence not willing to donate.
It is like chicken and egg, we are asking people to donate to see change, some are saying change is not there and donation does not make a difference.
If it is so difficult to collect 10,000 US$ a month how can your plan collect 5 million ?
If someone is going to ask you the following questions what are your answers,
1) If i donate 50$ what is the feedback (in terms of info, progress) that i will get?
2) What will you do if the administration thanks us and takes the donation and gives it off to a non-profit education organization. (giving donation does not mean that they will do something for us). Then what do we do.
Instead can we not use that money to lobby for our goals.
Okay folks, how about this approach?
Since a lot of people do not donate because they think it won't make a difference, how about setting up an escrow-like account, which, if it meets its target (say $5M), is used for the purpose intended.
In case it falls severely short of the target by the due date, then everybody's money is returned without deducting any processing fee.
Any comments?

Looks like for July 2nd they just started and i talked to 5 other guys( who got receipt) - all of them has a sending time between 9 and 9:30 AM by FEDEX
Mine went around 11:30 by USPS on July 2nd - so i have to wait for at least 2weeks. 1 hr late means 1 week delay !!

I also just got off the phone with USCIS, I am July 2nd filer with no receipts yet. The nice lady at USCIS customer service told me that due the increase in the in-flux of applications, it is taking USCIS longer to generate the receipt notices. She told me to call them back after 2 weeks.

I never thought that working for a contractor was something bad!! In fact, I was thinking that contracting is better than working full time! Am I missing something here???
I mean think about it... you get to work on different projects and you get to learn new stuff, new environments, new people!
Stay as a full timer and you don't grow (well not like a contractor anyways!). All in all, I think it takes more effort to be a contractor!
I guess it is a career choice! I personally would rather be a contractor!
It's definitely a 'Choice' which means - "its Personal" - Maybe for Career or for money or maybe because babes love consultants !!! :) ..
The 'loser' is the one who tries to judge that "Choice", by saying their choice is better ;)

Today I got a call from an officer in "immigration and customs enforcement" asking for an appointment to visit my residence for checing my immigration status.
I am on H1B visa.
I would appreciate if someone could give any sort of information related to calling for a home visit.

I got LUDs on 2/10 on both mine and my wife's 485. My wife got an RFE email on 02/13. I do not know what this means either...
Did you recieve the RFE yet ?What was it about. Mine is a similar case. We both have LUDs on 02/10 and my wife's 485 recieved an RFE email today.
